Alternative dispute resolution (“ADR”) includes any method of resolving disputes other than by litigation. Although public courts sometimes review the validity of ADR methods, they rarely overturn such decisions and awards -- provided that the disputing parties have formed a valid contract. Available forms of ADR include:
- Mediation. This process involves a third-party mediator who helps both parties come to an agreement. The mediator does not issue a final decision, but rather facilitates the process and keeps the discussing moving forward.
- Negotiation. Through this process, you meet with the other party to come to a shared point of understanding. Identifying each party's top areas of concern often facilitates drafting a resolution agreement.
- Arbitration. With arbitration, a designated third party serves as a neutral overseer, whose decision the organizations or individuals involved in the dispute agree beforehand will be final. The result is an agreement that is both enforceable and fair.
