Jordan Guydon’s Arbitration and Dispute Resolution practice combines cultural sensitivity with integrity, knowledge, and creativity to provide clients with excellent opportunities to resolve business and international business disputes. Our lawyers have served governments, businesses, and individuals facing problems around the country. Our lawyers help clients navigate through national disputes, regardless of the forum – arbitration, litigation, negotiation, or government investigation. In prior representation, we coordinated legal proceedings that were pending in multiple jurisdictions so that they complemented, rather than interfered with, one another.
Our attorneys have a broad range of experience and talent in negotiation, which is essential in reaching successful results for our clients. That experience allows us to build trusted relationships with professionals and specialists around the country. Our attorneys’ collective knowledge and relationships create a unique network to address and respond to each client’s particular business and legal needs.
Alternative dispute resolution (“ADR”) includes any method of resolving disputes other than by litigation. Although public courts sometimes review the validity of ADR methods, they rarely overturn such decisions and awards — provided that the disputing parties have formed a valid contract. Available forms of ADR include:
- Mediation. This process involves a third-party mediator who helps both parties come to an agreement. The mediator does not issue a final decision, but rather facilitates the process and keeps the discussing moving forward.
- Negotiation. Through this process, you meet with the other party to come to a shared point of understanding. Identifying each party’s top areas of concern often facilitates drafting a resolution agreement.
- Arbitration. With arbitration, a designated third party serves as a neutral overseer, whose decision the organizations or individuals involved in the dispute agree beforehand will be final. The result is an agreement that is both enforceable and fair.
We routinely advise clients on the elements of an effective and enforceable dispute resolution clause that will maximize their chances of success if a dispute later arises. If disputes arise, we guide our clients through the many strategic choices they face in the arbitration. We have the capacity and experience in counseling clients from start to finish due to our understanding of the serious business and legal consequences that can result from a misstep along the path to arbitration. We advise clients from all over the country on both institutional and ad hoc arbitrations. Our lawyers are experienced advocates, conducting arbitrations under the major national arbitral institutions.
